In these terms, “Demarcus”, “we”, “us” and “our” refer to The Demarcus LLC. By browsing the site or placing an order you accept these terms. If you do not accept them, please do not use the site.
2. Eligibility
You must be at least 18 years old, or have the consent of a parent or legal guardian, to place an order. By ordering you confirm that the payment method used belongs to you or that you are authorised to use it.
3. Products & Descriptions
We sell gaming peripherals, accessories and related consumer electronics. We make every effort to describe products and display images accurately, but colours may vary between screens and manufacturers occasionally change specifications or packaging without notice. Product images are for illustration.
4. Pricing
All prices are listed in US Dollars (USD) and are inclusive of applicable taxes unless stated otherwise at checkout. Shipping is calculated separately and shown before you confirm payment.
We reserve the right to correct pricing errors. If an item is listed at an incorrect price, we will contact you before dispatch and you may confirm the order at the correct price or cancel it for a full refund.
5. Orders & Acceptance
Your order is an offer to buy. A contract is formed only when we send you a dispatch confirmation email. We may decline or cancel an order where the item is out of stock, where a pricing error has occurred, or where we suspect fraudulent activity. Any payment taken for a cancelled order is refunded in full.
6. Payment
Payments are processed securely through PayPal, which also accepts major debit and credit cards. You do not need a PayPal account to pay by card. We do not store or have access to your full card details at any time. Payment is taken at the time the order is placed.
7. Shipping
Delivery timeframes, costs and responsibilities are set out in our Shipping Policy, which forms part of these terms. Risk in the goods passes to you on delivery.
8. Returns & Refunds
Your return and refund rights are set out in our Refund & Returns Policy, which forms part of these terms. Nothing in these terms limits your statutory consumer rights.
9. Warranty & Liability
Products are covered by the manufacturer’s warranty as described on the product page, with a minimum of 12 months against defects. To the fullest extent permitted by law, our total liability in connection with any order is limited to the amount you paid for that order. We are not liable for indirect or consequential losses, including loss of data, loss of profit, or loss of gaming progress.
10. Acceptable Use
You agree not to use this site to transmit malicious code, attempt to gain unauthorised access to our systems, scrape content at scale, or place fraudulent orders. We may suspend access where we reasonably believe these terms have been breached.
11. Intellectual Property
All site content — including text, layout, graphics and logos — is owned by The Demarcus LLC or its licensors and may not be reproduced commercially without written permission. Third-party brand names and product images remain the property of their respective owners and are used to identify the products we sell.
